V 8. \u010dasti v \u00a7\u00a7 55-61 tohto z\u00e1kona sa konkr\u00e9tnej\u0161ie upravuje zamestn\u00e1vanie ob\u010danov so zdravotn\u00fdm postihnut\u00edm.<\/p>\n<p><strong>Chr\u00e1nen\u00e1 diel\u0148a a\u00a0chr\u00e1nen\u00e9 pracovisko<\/strong> s\u00fa pracovisk\u00e1 zriaden\u00e9 pr\u00e1vnick\u00fdmi alebo fyzick\u00fdmi osobami, v ktor\u00fdch s\u00fa zamestnan\u00ed ob\u010dania so zdravotn\u00fdm postihnut\u00edm, ktor\u00ed nie s\u00fa schopn\u00ed n\u00e1js\u0165 si zamestnanie na otvorenom trhu pr\u00e1ce. Ob\u010dan so zdravotn\u00fdm postihnut\u00edm na \u00fa\u010dely tohto z\u00e1kona je ob\u010dan uznan\u00fd za invalidn\u00e9ho, teda m\u00e1 pokles schopnosti vykon\u00e1va\u0165 z\u00e1robkov\u00fa \u010dinnos\u0165 o\u00a0viac ako 40% v\u00a0porovnan\u00ed so zdravou osobou. Postavenie chr\u00e1nenej dielne alebo chr\u00e1nen\u00e9ho pracoviska vyd\u00e1vaj\u00fa \u00farady pr\u00e1ce, soc. vec\u00ed a\u00a0rodiny na z\u00e1klade kladn\u00e9ho posudku org\u00e1nu na ochranu zdravia. Priznan\u00edm postavenia chr\u00e1nenej dielne alebo chr\u00e1nen\u00e9ho pracoviska vznikaj\u00fa zamestn\u00e1vate\u013eovi vo\u010di osob\u00e1m so zdrav. postihnut\u00edm povinnosti, vypl\u00fdvaj\u00face zo Z\u00e1konn\u00edka pr\u00e1ce a\u00a0Z\u00e1kona o\u00a0slu\u017eb\u00e1ch zamestnanosti, ktor\u00e9 smeruj\u00fa k\u00a0vytvoreniu \u00a0podmienok umo\u017e\u0148uj\u00facich t\u00fdmto osob\u00e1m riadne a\u00a0bezpe\u010dne vykon\u00e1va\u0165 svoju pr\u00e1cu.<\/p>\n<p>Pre priznanie postavenia chr\u00e1nenej dielne je zamestn\u00e1vate\u013e povinn\u00fd vytvori\u0165 minim\u00e1lne dve pracovn\u00e9 miesta pre ob\u010danov so zdravotn\u00fdm postihnut\u00edm, pri\u010dom ob\u010dania so zdravotn\u00fdm postihnut\u00edm musia tvori\u0165 najmenej 50%z\u00a0celkov\u00e9ho po\u010dtu zamestnancov. Pre priznanie chr\u00e1nen\u00e9ho pracoviska je mo\u017en\u00e9 vytvori\u0165 iba jedno miesto pre ob\u010dana so zdravotn\u00fdm postihnut\u00edm, pri\u010dom nie je potrebn\u00e9 sledova\u0165 percentu\u00e1lny podiel ob\u010dana so zdravotn\u00fdm postihnut\u00edm na celkovom po\u010dte zamestnancov. Za chr\u00e1nen\u00e9 pracovisko sa pova\u017euje aj pracovisko, na ktorom ob\u010dan so zdravotn\u00fdm postihnut\u00edm prev\u00e1dzkuje samostatn\u00fa z\u00e1robkov\u00fa \u010dinnos\u0165 a m\u00f4\u017ee by\u0165 zriaden\u00e9 aj v\u00a0jeho dom\u00e1cnosti. Za chr\u00e1nen\u00e9 dielne a\u00a0chr\u00e1nen\u00e9 pracovisk\u00e1 sa m\u00f4\u017eu pova\u017eova\u0165 aj v\u00fdrobn\u00e9 dru\u017estv\u00e1 invalidov. Zoznam chr\u00e1nen\u00fdch dieln\u00ed a\u00a0chr\u00e1nen\u00fdch pracov\u00edsk je uveden\u00fd na str\u00e1nke \u00dastredia pr\u00e1ce, soci\u00e1lnych vec\u00ed a rodiny<\/p>\n<p><strong>Pr\u00edspevok na zriadenie chr\u00e1nenej dielne alebo chr\u00e1nen\u00e9ho pracoviska<\/strong> m\u00f4\u017ee poskytn\u00fa\u0165 pr\u00edslu\u0161n\u00fd \u00farad pr\u00e1ce, soci\u00e1lnych vec\u00ed a\u00a0rodiny zamestn\u00e1vate\u013eovi na z\u00e1klade p\u00edsomnej \u017eiadosti na \u00fahradu \u010dasti n\u00e1kladov pre vytvorenie pracovn\u00e9ho miesta pre ob\u010dana so zdravotn\u00fdm postihnut\u00edm, ak je veden\u00fd v\u00a0evidencii uch\u00e1dza\u010dov o\u00a0zamestnanie najmenej jeden mesiac. V\u00fd\u0161ka pr\u00edspevku je z\u00e1visl\u00e1 od celkovej ceny pr\u00e1ce, regi\u00f3nu a\u00a0miery evidencie nezamestnanosti v okrese<\/p>\n<p><strong>Pr\u00edspevok na udr\u017eanie ob\u010dana so zdravotn\u00fdm postihnut\u00edm v\u00a0zamestnan\u00ed<\/strong> m\u00f4\u017ee \u00farad pr\u00e1ce, soci\u00e1lnych vec\u00ed a\u00a0rodiny poskytn\u00fa\u0165 zamestn\u00e1vate\u013eovi, ktor\u00fd zamestn\u00e1va viac ako 25% ob\u010danov so zdravotn\u00fdm postihnut\u00edm a ak nem\u00e1 postavenie chr\u00e1nenej dielne alebo chr\u00e1nen\u00e9ho pracoviska \u00fahradu preddavku na zdravotn\u00e9 a soci\u00e1lne poistenie a\u00a0na starobn\u00e9 d\u00f4chodkov\u00e9 sporenie vo v\u00fd\u0161ke, ktor\u00e1 sa vypo\u010d\u00edtav\u00e1 najviac zo 60% priemernej mzdy zamestnanca v\u00a0hospod\u00e1rstve SR za z\u00e1konom stanoven\u00e9 obdobie<\/p>\n<p><strong>Pr\u00edspevok ob\u010danovi so zdravotn\u00fdm postihnut\u00edm na samostatn\u00fa z\u00e1robkov\u00fa \u010dinnos\u0165<\/strong> m\u00f4\u017ee \u00farad pr\u00e1ce, soci\u00e1lnych vec\u00ed a\u00a0rodiny poskytn\u00fa\u0165 na \u010diasto\u010dn\u00fa \u00fahradu n\u00e1kladov s\u00favisiacich s\u00a0prev\u00e1dzkovan\u00edm samostatnej z\u00e1robkovej \u010dinnosti uch\u00e1dza\u010dovi o\u00a0zamestnanie, ktor\u00fd je ob\u010danom so zdravotn\u00fdm postihnut\u00edm veden\u00fdm v\u00a0evidencii uch\u00e1dza\u010dov o\u00a0zamestnanie \u00a0najmenej 3 mesiace a\u00a0bude samostatn\u00fa z\u00e1robkov\u00fa \u010dinnos\u0165 prev\u00e1dzkova\u0165 na chr\u00e1nenom pracovisku najmenej dva roky. Neposkytuje sa na \u00fahradu preddavku na zdrav. a\u00a0soci\u00e1lne poistenie, na povinn\u00e9 pr\u00edspevky na starobn\u00e9 d\u00f4chodkov\u00e9 sporenie a\u00a0ani na n\u00e1jom. V\u00fd\u0161ka pr\u00edspevku je z\u00e1visl\u00e1 od celkovej ceny pr\u00e1ce, regi\u00f3nu a\u00a0miery evidencie nezamestnanosti v\u00a0okrese.<\/p>\n<p><strong>Pr\u00edspevok na \u00fahradu prev\u00e1dzkov\u00fdch n\u00e1kladov chr\u00e1nenej dielne alebo chr\u00e1nen\u00e9ho pracoviska<\/strong> sa poskytuje zamestn\u00e1vate\u013eovi \u00a0ak o\u0148 po\u017eiada \u00farad pr\u00e1ce, soc. vec\u00ed a\u00a0rodiny v\u00a0z\u00e1konom ur\u010denom term\u00edne.
